The person that does not have legal custody of the child(ren); few, if any, parental rights concerning the child(ren); and usually required to pay child support.
If both parents have 5050 custody of children what happens if one parent becomes incarcerated does that parent lose their custody?

You would have to go back to court. Have your attorney file for a modification of custody order. Your ex would be notified through his attorney and would have to answer your allegation.
